DB ZION ALPHA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (incorporated June 22, 2023, KRS 0001043322) governs use of its platform at https://zionpayment.com/ and the Zion app.
The company provides two main services: cryptocurrency-to-fiat and fiat-to-cryptocurrency exchange, plus custodial wallet services for holding and managing supported digital assets.
Key Policy Changes
Zion has the right to unilaterally change and modify terms and conditions at any time. Changes become effective upon website publication. Continued use indicates acceptance.
1. Definitions
Account
Users may create only one account for personal use. You are fully responsible for all activity that occurs on your account.
Wallet
Platform-generated cryptocurrency storage created at user request.
Stored Cryptoassets
User-owned digital assets held in wallets. Zion cannot borrow, sell, or transfer without consent except when legally required.
Order
Encompasses cryptocurrency purchases, sales, deposits, or withdrawals through the platform.
2. Service Provision Principles
- Zion may request additional information and documents as required by law
- Available cryptocurrencies may change without notice
- The company does not store fiat currency on behalf of users
- Zion does not provide financial or investment advice
- Cryptocurrencies are highly volatile assets
- Personal data treatment follows the Privacy Policy
3. Order Processing
Orders process through DB ZION ALPHA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with exceptions for certain US states listed in the document. Custodian Wallet Services are provided directly by the company.
Order Completion
Occurs when cryptocurrency transfers to user wallets, fiat transfers to indicated accounts, or assets deposit into specified blockchain addresses.
Processing Fees
Applied and disclosed before authorization.
Withdrawal Requirements
Wallets must maintain sufficient balance including applicable fees.
Price Fluctuations
If the cryptocurrency amount to be sent differs by more than 2% between the time the order is submitted and processed, Zion reserves the right to reject the transaction.
Large Discrepancies
Orders with cryptocurrency amounts differing by over 20% may be unilaterally rejected.
Inaccurate Information
Users bear refund fees if false information prevents completion.
Irreversible Transfers
The return of the transferred funds is not possible after the order is completed.
Security Holds
Zion may temporarily hold funds during suspected attacks or hacking attempts.
Company Liability
Limited to funds received for order execution.
4. Liability and Indemnification
Zion makes no representations or warranties regarding the amount of time needed to complete processing.
Service Basis
Provided "as is" and "as available" without express, implied, or statutory warranties.
Liability Limitations
The company cannot be held liable for price data inaccuracies, transmission errors, or data interruptions.
Damages Exclusion
No liability for lost profits, data breach, or indirect damages — except to the extent of a final judicial determination that such damages were a result of Zion's fraud, willful misconduct or intentional violation of applicable law.
User Indemnification
Users must indemnify Zion and related parties from claims arising from service use, term violations, or policy breaches.
Third-Party Disclaimer
Zion bears no responsibility for third-party investment advisors or services. Users should maintain personal wallet control.
5. Acceptable Use
Users agree not to:
- Act illegally, defiantly, threateningly, or harassingly
- Impersonate others
- Disguise location via IP proxying
- Violate intellectual property or publicity rights
- Violate applicable laws or regulations
6. Dispute Resolution
Initial disputes require mutual negotiation via support@zionpayment.com.
Governing Law
Polish Law applies exclusively. Polish courts hold jurisdiction.
Digital Agreements
Digital forms of these terms possess legal equivalence to written, signed documents.
7. Third Parties
Personal information may be shared with third-party partners per the Privacy Policy and applicable law requirements.
8. Termination
Zion may terminate access without notice at its discretion. Users may terminate accounts anytime.
9. Eligibility Requirements
Users must be:
- At least 18 years old
- Not previously suspended
- Not located in or resident of restricted jurisdictions
- Legally permitted to use services in their jurisdiction
Consequences
Zion may reject orders and freeze assets upon detecting false eligibility information.
Restricted Jurisdictions for Exchange Services
Afghanistan, Belarus, Central African Republic, Cuba, Democratic Republic of the Congo, Ethiopia, Iran, Iraq, Lebanon, Louisiana, Libya, Mali, Myanmar, New York, Nicaragua, North Korea, Russia, Somalia, South Sudan, Sudan, Syria, Venezuela, Yemen, Zimbabwe, and disputed territories.
Restricted Jurisdictions for Custodian Wallet Services
Multiple US states: Alabama, Alaska, Arizona, Arkansas, Connecticut, Delaware, DC, Florida, Georgia, Idaho, Iowa, Kentucky, Maine, Maryland, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Vermont, Washington, West Virginia, plus Canada and Puerto Rico.
Special Jurisdiction Disclaimers
Select US States
Alabama, Alaska, Arkansas, Minnesota, Nevada, New Mexico, North Dakota, Puerto Rico, Vermont, Washington: No fiat-to-crypto orders for Axie Infinity (AXS), Binance Coin (BNB), Chiliz (CHZ), Holo (HOT), SushiSwap (SUSHI), Terra (LUNA), or TRON (TRX).
Texas
Stablecoin orders prohibited. Users confirm non-residency when submitting such orders.
Canada
Stablecoin sales prohibited by Canadian CSA. Users confirm non-residency.
10. Zero Hash Agreement
Customers from Alabama, Alaska, Arkansas, Minnesota, Nevada, New Mexico, North Dakota, Puerto Rico, Vermont, and Washington must accept Zero Hash LLC Services Agreement for exchange services.
11. Refund Policy
Detailed refund information available separately.
12. Complaints
Users may lodge complaints via support@zionpayment.com. Zion undertakes to deal with each complaint and issue a response within 15 days of the initial complaint.
UK Customers
Cryptoasset activities fall outside Financial Ombudsman Service jurisdiction and Financial Services Compensation Scheme protection.
13. Language Clause
The English version controls in disputes, despite translations into other languages.
